The Demise of the 28-Clause Peace Proposal for Ukraine: Why Diplomatic Efforts Continue to Falter

Europe felt a moment of respite on Monday, as the crisis caused by the introduction of a new 28-article proposal for achieving ceasefire appeared – momentarily – to have been contained. A Washington representative spoke of "substantial progress" after diplomatic discussions in Geneva. On Monday night, Moscow made its countermove: an extensive attack of rocket attacks on Kyiv.

The Rhythm of Peace Talks and Military Action

The succession of conflicting incidents captured the harsh reality of the current period. By day, diplomatic battles are fought: positive announcements are issued from multiple capitals. Significant resources is expended on restraining certain initiatives. By night, Russian leadership clearly shows the world that, for them, military action persists as the key method for achieving "peace".

After-Dark Attacks

As the offensive unfolded into the early hours of Tuesday, the present situation of Ukraine's exposure was laid bare. Ukraine is able to track projectile deployments from enemy soil, a capability enabled by up-to-date information. From vantage locations, Ukrainian air force fighter jets that had been scrambled to intercept incoming aerial threats roared overhead – modern combat jets provided to Ukraine by European allies.

Shortly after, Kyiv's missile defense activated: defensive missiles fired to intercept a hostile projectile. This was a sophisticated defense system at work, probably delivered by Western nations. Every deployment shakes the surroundings, causing tremors. The moment of terror quickly gives way to grim resignation: perhaps the hostile projectile won't cause damage this time, protecting urban areas from catastrophe and another blackout.

Persistent Threats

Soon after, a heavy machine gun opened up on a unmanned aircraft close by, part of a defensive team – almost certainly allied-provided weaponry. Regrettably, the projectiles didn't strike the opposing UAV – it pressed on overhead toward its destination.

With pauses, this persisted until dawn. Kyiv faced the early updates: multiple fatalities, destruction and infrastructure problems in multiple buildings as a result of the nocturnal offensive. As typically, everyone still continued their routines – living the war. But those full day encapsulated Ukraine's essential dependence on external assistance – a need that regional partners are evidently unprepared to fill in the short term.

Failed Diplomacy

The comprehensive proposal from American leadership sparked intense emotion, controversy and profound anxiety – and temporarily diverted attention from Ukraine's major integrity crisis in years. Yet, we have experienced comparable situations, after prior negotiation attempts and multilateral gatherings.

Every new approach from American administration unfolds according to the consistent cycle: a political offensive against Ukraine, which Kyiv, with other European capitals, effectively counters. They stabilise the situation but never actually achieve victory. This cycle will, no doubt, persist.

Political Considerations

It is convenient to criticize certain parties of persistently promoting Moscow's conditions. But that does not seem to be the entire situation. American leadership operates on a principle well known to experienced diplomats: you cannot win at the negotiating table what you have been unable to protect through force. The American government believes that it is impossible to pressure the Kremlin to abandon the areas that it presently holds in Ukraine's southern or eastern regions.

The issue is that while recognising this factual reality, Washington does minimal to deter Moscow, through statements or actions, from assuming that the current condition will not change more in its favour in the months ahead.

Divergent Views

Therefore, Russian leadership is certain that the clock favors them – that Ukraine and its allies are approaching exhaustion. Their incentive to sign a deal that does not give them the largest achievable advantage is almost completely absent. There may be many attempts to achieve ceasefire, but they will persist as long as Russia's government remains completely certain in the outcome.

On the contrary, Ukraine's government believes that Ukraine can still persist, slowly losing lives and land but averting a total frontline collapse until conditions improve in its favour.

Current Realities

Realistically, there are no actual prerequisites for a ceasefire. Now, personal considerations are coming into play: political desires to mediate resolution and secure international recognition, and Ukrainian leadership's double obstacles – on one hand, not to estrange crucial supporters, and on the other, to mobilize citizens around the country's interests against any plan Kyiv finds unacceptable, so that their priority does not shift toward homefront challenges. And although their objective will now be significantly challenging after recent developments, it remains quite doubtful that this will alter their fundamental strategy.

These conflicting dynamics are driving the talks.

Assessment and Future

It took a only one week to kill the proposed articles of the most recent proposal. Assertive and inconsistent approach of the matter by US administration, opposition by Ukraine and the rest of Europe, along with calming attempts of negotiators, and finally, latest revelations, all achieved their purpose.

While new proposals based on established approaches are forthcoming, Kyiv, London and other allied nations should reach an essential realization: Ukraine and Europe will only be able to counter negotiation assaults from Washington that are based on Russian demands and show particular unwillingness to alter the situation, if they remain united and improve their protective measures at a considerably quicker tempo. If they do, neither political nor armed coercion will be able to defeat them. In the meantime, Ukraine's capability to repel nightly air assaults will, for the coming months, largely rely on ongoing international assistance.
